Bank Fee Lawsuit Unveiled – 1m Kiwis Eligible

The big four Australian-owned banks – BNZ, ANZ, Westpac and ASB, along with state-owned Kiwibank – are being sued for a collective $1b in a massive class action lawsuit announced today.

Auckland-based lawyer Andrew Hooker, Australian consumer law firm Slater & Gordon and Litigation Lending Services, a litigation funding firm, are seeking plaintiffs to join a class suit against New Zealand’s registered banks to reclaim fees charged when customers overdraw their accounts, pay credit card bills too late, or bounce a cheque.

“The reason for this class action is the unlawful overcharging of kiwis for many many years,” Hooker told media in Auckland. “Under contract law in New Zealand, default fees must reflect actual costs to the party charging those default fees.”

Hooker claims the banks have breached contract law by charging a fee that is higher than what it costs them when the payment defaults. The action will go back over six years.

The group says bank customers are being charged around $15 every time they overdraw their accounts when they estimate it only costs the banks a few cents when the transaction occurs.

Up to one million Kiwis may be eligible to sign up for a slice of the overcharged fees, it said.

Hooker said Kiwis could be paying up to $1500 more a year than they should be.

“After they have taken the money it is up to the customer to fight them.”

But few people would take their bank to court for $15, he said. “The banks rely on this.”

The New Zealand action comes after a similar suit across the Tasman, where ANZ is being treated as test case.

Hooker said the market share of the local banks would probably be representative of their share of the suit, with the Australian-owned banks and state-owned KiwiBank the biggest offenders.

Michelle Silver, managing director of Litigation Lending Services, said the action has a minimum threshold of 10,000 people to proceed and she expects at least 50,000.

The funding firm stands to gain a 25 per cent commission if successful on a no-win no-fee basis, while Hooker expects his legal costs and disbursements to be $3.5 million.

The proceeding comes as Justice Minister Judith Collins works on legislation to enable faster, better and cheaper class suit actions. That policy work was expected to be done last year.

Shares in Australia & New Zealand Banking Group edged up 0.03 per cent to $36.21 on the NZX, while Westpac Banking slipped 0.1 per cent $38.77.

A website has been launched for people who want to be part of the lawsuit to register.

The website – “Fair Play on Fees” describes that action being taken like this:

“When your account balance runs low or you are late with a credit card payment, the last thing you need are extra fees; yet for years that’s exactly what the banks have been hitting you with.

They’re called ‘exception fees’, and you’re charged them when your account goes into unexpected overdraft, you exceed your credit card limit or make a late payment. Even if the bank doesn’t allow a payment to go through, they’ll still charge you a ‘dishonour fee’ for the so-called service. We estimate that New Zealanders have paid the banks around $1 billion in these fees over the past six years.

We think that these fees are unfair and should be challenged in court. Although the amounts ($15 to $35) sting you, because litigation is expensive it has not been worth taking the banks on by yourself. In Australia, lawyers have launched class actions valued at about $280 million to recover these fees. We think it’s time for New Zealanders to band together and stand up to the banks.

Claimants are being told that “there is nothing to lose, and no upfront cost.”

The lawyers involved said that if anyone had been “hit by one or more of these fees over the past six years, all you need to do is sign up.”

“Unlike the banks, we’re not about to charge you fees for no obvious gain. Instead, Litigation Lending Services (NZ) will fund all the legal costs, in exchange for a right for them to be reimbursed if the claim succeeds along with 25 per cent of the compensation.”

President Enrique Pena Nieto moved Monday to overhaul and strengthen the weak and chaotic regulations that have allowed the world’s richest man and its largest Spanish-language media empire to exert near-total control of Mexico’s lucrative telephone and television markets.

The reforms would give the Mexican government tools to take on multibillionaire telephone tycoon Carlos Slim and Televisa CEO Emilio Azcarraga, independent observers said. The two rivals’ holds on their respective markets have been widely seen as emblems of regulatory dysfunction in a country aspiring to join the ranks of the world’s economic superpowers.

Their companies’ pervasive influence has repelled a series of attempts to break their dominance over the years. The tycoons’ power could thwart fresh efforts despite Pena Nieto’s push to put teeth into Mexico’s deeply flawed regulatory system, experts said.

The reforms would create two new national television channels and form a new independent regulatory commission along the lines of the U.S. Federal Communications Commission, with the power to unilaterally punish non-competitive practices, including withdrawing corporations’ licenses. A second independent commission would be able to order firms to sell off assets in order to reduce their market dominance.

The existing commissions that oversee competition and telecommunications have no independent ability to alter permits, order divestment or issue fines. Those powers sit with a Cabinet secretary, a position that in the past frequently has been accused of bowing to telecommunications firms.

The reforms would require TV networks to provide their programming free to most cable operators, and require cable operators to carry all broadcast channels, measures seen as essential for opening television markets to competition. The changes would also block telecommunications and broadcasting companies from indefinitely freezing regulatory decisions simply by obtaining a private injunction, a peculiarity of Mexican law that has thwarted dozens of attempts to regulate media and communications firms.

The reform’s purpose is “to accelerate competition in telecommunications and broadcasting …freeing the potential of the sector, and doing it in the fastest time possible,” Pena Nieto said before signing the proposal along with the leaders of the country’s major parties.

The changes to the constitution and federal telecommunications laws must now be approved by congress and half of Mexico’s 32 state legislatures.

“It seems, at the start at least, like they’re taking up substantial issues in order to make structural changes in the way telecommunications and broadcasting work in this country,” said Aleida Calleja, president of the Mexican Association for the Right to Information, a group that has campaigned for stricter regulation and increased diversity in the telecoms and television markets. “It seems to me like it’s an extremely valuable start.”

Televisa’s political influence has also become one of the rallying cries of the Mexican left, which often accuses the conglomerate of trading positive coverage of politicians for favorable regulatory treatment. Pre-election protests against Pena Nieto focused on his ties to Televisa, a historic ally of his Institutional Revolutionary Party, which ruled Mexico for seven decades before losing the presidency in 2000.

Pena Nieto has spent his first 100 days reasserting the power of Mexico’s once-imperial presidency, most dramatically jailing the head of the teacher’s union in the midst of a fight over reforms to the country’s sclerotic education system.

Backers of the new reform and some independent experts cast it as a similar blow against entrenched special interests, pledging that it would open Mexico’s multi-billion dollar a year telecommunications business to true competition that would drive down some of the world’s highest prices for telephone service and diversify a television market dominated by a single company.

“The rules of the game will be fairer, above all for the small and medium companies that have been tied down in their efforts to develop and expand their businesses by the monopolistic practices of Carlos Slim and the television company, particularly Televisa,” said Gabriel Sosa Plata, a researcher and telecommunications expert at the Metropolitan Autonomous University in Mexico City.

Slim’s Telmex, the privatized former national phone company, controls 80 percent of Mexican landlines and 70 percent of the mobile-phone market. Azcarraga’s Televisa has 70 percent of the broadcast TV market and more than 45 percent of cable television.

Televisa said in a written statement that, “We welcome the proposed constitutional reform, which will promote competition in broadcasting and telecommunications.” Telmex did not immediately respond to a request for comment.

Slim’s companies have maintained profit margins nearly double the average in the 34-nation Organization for Economic Cooperation and Development, while Mexico has the group’s lowest rate of telecommunications investment per capita and sat at or near the bottom in terms of number of fixed and mobile phone lines per capita, according to a scathing OECD report last year.

The report, much of which was fiercely disputed by Slim, found that what it called the dysfunction in telecommunications cost the Mexican economy more than $30 billion a year.

The new regulator’s ability to potentially force companies to sell assets in order to reduce their market power and avoid withdrawal of their licenses is “a pretty powerful tool and certainly unlike anything Mexico’s ever seen before,” said Christopher King, a telecommunications analyst with investment banking firm Stifel Nicolaus.

He described the reform as “bad news” for both American Movil and Televisa, but cautioned that its true impact would only be seen if and when the reforms passes into law regulators begin to act.

“In terms of how bad the news ultimately is, the devil will be in the details,” he said.

Stock in Televisa was down slightly by mid-afternoon while Slim’s America Movil dropped more than 2 percent.

As you look around you, my dear, you can see clearly from what is happening in many countries as people come together, and from the many emails that you receive, that the shift has started and it is gathering momentum. The 3D control system is losing ground every day, in just a few weeks this will become very obvious to everyone. I told you that the most powerful beings from ages past returned to Earth. They are making themselves known and they are leading the way forward to bring about the complete transformation of your planet.

This is what is clearly happening in Ireland, as people take on the corrupt organisations that until now controlled every aspect of their lives. The Irish people show dignity and respect as they come together in strength to expose corrupt practices and demand justice. Because they have adopted this method, they will be successful. It is the only way to deal with the corrupt. They are succeeding in exposing all that is corrupt and you know that EXPOSURE is what the Cabal fears. Up to now, they have controlled everything, but this is no longer the case. The people have taken control. They are the leaders in this struggle. They have the admiration of those on both sides of live.

When you wake up to what is possible just by coming together and taking peaceful action, then you will realise the strength of the power of the 99%. You cannot be lied to anymore. You now see through all the lies and you wonder how you could ever have been taken in by such people. Be aware that the Cabal will try every trick in its extensive repertoire to keep you servile to it. The door to enlightenment is open to all. It is your decision as to whether you walk through it. Do not allow fear to hold you back.

We in Spirit, are beside you every step of the way. We show you the way forward but we cannot do it for you. This is a human problem and it needs humanity to take action to resolve it. The puppets who pretend to make decisions are becoming so obvious now, they are beginning to look ridiculous. Even they will realise that the game is up and will withdraw. They are trying to persuade the people that another war is necessary. You know why they want war and why they create situations, and then insist that people need to be rescued, when all the time the world needs to be rescued from their clutches. These people are devoid of conscience. They think that they can continue to fool the world with their pious words.

Each day more atrocities are being exposed. This has to happen as they need to be exposed in order to ensure that they never happen again. The victims need to be acknowledged and compensated for what they have suffered. When the Vatican files become public property, the true extent of its criminal activities will become known. Then, and only then, will the world fully understand what was done when their take-over happened, and, just as important, who they are in league with.

When all that is evil and corrupt is removed, your world will be as one, with all people coming together, sharing their knowledge to assist countries that have been deliberately kept down while being plundered by the powerful. There is a wealth of ancient knowledge in those countries that has been kept from you. You were taught only what the corrupt wanted you to know, and thereby, they have controlled your minds. You, because of your desire for truth, are bringing about the changes that will completely change life on Earth. You will ensure that the future of humanity is secured and that Earth will re-establish itself, without interference from evil, outside forces. It is a big task but one that you undertook willingly. Here in Spirit, we do not see differences as on Earth, where you are encouraged to acknowledge differences of race and religion. These ‘differences’ were man-made to cause trouble among you and they have worked until now. But their brainwashing tactics no longer work and you cannot be so easily fooled anymore. You now feel liberated and are able to distinguish lies from the Real Truth. The future is yours, handle it with great care and discernment. You have achieved more than you realise. You have emerged from the darkness of control and can now see the future clearly. You have come together – all different nationalities and belief systems – all wanting the same goal which is the removal of corruption. You will never again kill each other in war. Together, there is no limit to what you can and will achieve. The old system can never again return: it is finished. You will learn to take each others hands in friendship and cooperation. You have much to share and teach each other.

My dear wife wants so much to see this happen. It has always been her dream to see everyone live together peacefully with love and justice for all. I have promised her that she will see this. It is now up to all of you, how soon this will happen. Once you make the decision to go forward, nothing can stand in your way. The Cabal cannot control all of you.

As you become fully awake, you will begin to remember other lives that you have lived. This will bring an understanding as to why you are on Earth at this time of transition, and what your role is, in all that is happening. Also, why you have connected with certain people. This is the greatest adventure of your many lives on Earth.

Be there for each other as I continue to be there for Veronica. Support and comfort each other. Together, you are invincible.

My dear, it is all in divine hands and with this assurance, know that everything will go according to plan. It is a difficult path, but you know in your heart that you can, and will do it, when the timing is right.

Enjoy all the beautiful flowers that were given to you, this Mothers Day. It is lovely to see our home filled with flowers. You are not alone, my dear, you now have friends all over the world, who walk with you and send love to you. They will be there to celebrate with us when we complete our project. It is all in hand. SACRAMENTO, Calif. (AP) -- Labor and environmental groups on Tuesday joined some of the more liberal Democrats in the state Legislature in announcing a coalition to oppose reforms sought by Gov.Jerry Brown to the California Environmental Quality Act.

Overhauling the law to prevent abuse is one of the governor's top priorities this year, but opponents say the act has served a vital role in protecting the state's air and water over its four-decade history.

Signed into law by then-Gov. Ronald Reagan in 1970, the law requires public agencies to weigh the potential environmental effects of proposed development.

Critics say it has drifted from that purpose, instead being used to delay projects, seek labor concessions and undermine competing developers.

Common Ground, the new coalition group opposing reforms, commissioned a report as part of its effort to emphasize the importance of the law.

The study by Peter Philips, a University of Utah economics professor, points to the state's record in building alternative-energy projects and maintaining construction jobs as evidence that the law is working.

"Has CEQA actually hindered construction? Far from it," said Bob Balgenorth, chairman of theCalifornia Construction Industry Labor Management Cooperation Trust. "If anything, it's facilitated greater construction, a cleaner environment and a better quality of life for Californians."

Brown and the Legislature's Democratic leaders are negotiating changes after an attempt to pass a bill failed last year.

The governor's office had no comment on the report, but Brown has advocated for more consistent standards in reviewing development projects.

A separate coalition of business, labor and government organizations supports changes to the law that would make it easier to build.

Republican Sen. Tom Berryhill of Stanislaus has re-introduced a proposal for streamlining the review process that was pushed last year by former Sen. Michael Rubio, D-Bakersfield.

The reform effort was led by Rubio until he resigned last month to take a job with Chevron.

Opponents of revising the environmental act acknowledged criticism that the law has been misused by those seeking to block projects for non-environmental reasons. But they argued that the law's benefits outweigh the number of times it has been used for frivolous lawsuits.

"The question for us today as policymakers and advocates is, is this claimed abuse enough to give away the next generation's clean air and clean water and the next generation's agricultural lands and open spaces and wild places?" said Sen. Noreen Evans, D-Santa Rosa. "We must not confuse private profit with public good."

The identity of the new pope, Cardinal Jorge Mario Bergoglio, was revealed a short time later when the 76-year-old Argentinian Archbishop emerged on the balcony of St. Peter's Basilica, having been chosen by a group of 115 cardinal-electors. Voting took place by secret ballot on Tuesday and Wednesday in a cloistered meeting known as a conclave.

Pope Francis, as he will be called, is the 266th pontiff in the Church's 2,000-year history and the first to hail from South America.

Pope Francis' predecessor, Pope Benedict XVI, made history in February when he announced in a letter that he was leaving the Papacy after eight years. His resignation from the post was the first since 1415.
