New Bill Allows Military To Detain You Indefinitely









It’s a bad sign when George W. Bush’s defense team thinks that a military bill goes too far in violating your rights. But we’ve got just that with the passing of the National Defense Authorization Act. This bill authorizes the military to detain American citizens indefinitely without giving them their Constitutional rights. Basically, if the military suspects that an American citizen has terrorist ties it can just throw them in military jail without the rights to habeas corpus, an attorney or just about anything.

Let’s say that again — this new bill, which passed the Senate with an alarming majority, allows the military to arrest American citizens on American soil and keep them without trial. It’s being called the “America the Battlefield” bill, because it treats your front yard like a battlefield — and every citizen like a potential enemy. It basically puts a giant asterisk next to the Bill of Rights saying, “unless we don’t feel like it.”

It’s no wonder that former a Bush State Department adviser said that this bill “would likely have been as strongly opposed by the Bush administration as by the Obama administration.” The same people who brought us waterboarding and the PATRIOT Act think that this is a step too far.

In fact, the only people who think that this is a good idea are the people who voted for it in Congress, which has an approval rating lower than that of BP during the oil spill or Hugo Chavez, just to name a few. Even those who trying to see the law with an optimistic light, as Atlantic’s Andrew Cohen does, can only concede that at best “the Senate avoided the worst result here.” Not exactly ringing praise.

The Obama administration has signaled that it might veto this egregious attack on Americans’ rights, but his decision is still up in the air. To let him know how important constitutional liberties are to them, thousands of people are petitioning the President to veto the bill. If he fails to veto, it will likely go to the Supreme Court.

Maybe it’s not so bad — since corporations are people, the government could just indefinitely detain Goldman Sachs.

Yes Amanda, all this is in line with the info in my previous post and I can imagine how vulnerable US common citizens will be in the face of any upcoming terror event if it proves true. I for one would feel horrified if in my country we were threatened by a similar situation. The following paragraph from the article at Prison Planet has just put my hair on end:

"We are quite literally one terror event away from the plan going live. As the DHS and the establishment media keep telling us, the next terror event will be on American soil and not the work of al-Qaeda but domestic patriot political groups. The FBI has specialized in creating domestic terrorists – or rather patsies – and shifting the blame over to their political enemies."

The president says some of the richest Americans pay a smaller percentage in taxes.The actual numbers

In case you haven't heard, President Obama wants the wealthiest to pay more in taxes.

Noting the rise in income inequality in recent years and the need to reform the U.S. tax system, the president on Tuesday said that some of the wealthiest in America pay far less in federal taxes as a percentage of their income than many lower down the income scale.

"A quarter of all millionaires now pay lower tax rates than millions of middle-class households. Some billionaires have a tax rate as low as 1%," Obama said in a speech in Kansas.

Here are some of the facts behind the claim: In 2006 roughly 25% of those with adjusted gross incomes over $1 million paid a smaller portion of their income in federal taxes -- income, payroll and corporate -- than 10% of those with AGIs below $100,000, according to a recent study from the Congressional Research Service.

As for the president's assertion that some billionaires have a tax rate as low as 1%, Roberton Williams, a senior fellow at the Tax Policy Center, said that it's definitely possible but hard to verify.

Buffett rule could hit 25% of the very rich

"Billionaires are still rare enough that we cannot get data for them without running afoul of privacy rules," he said.

But for a lot of reasons, Chris Bergin, president and publisher of Tax Analysts, said, "It is certainly not implausible."

Last year, 4,000 households with incomes over a million dollars owed no federal income taxwhatsoever, according to Tax Policy Center estimates.

What's more, of the top 400 federal tax returns with the highest adjusted gross incomes in 2008, 30 had an effective tax rate of less than 10%, noted Mark Luscombe, the principal federal tax analyst at CCH.

A big reason is that a large percentage of wealthy Americans' income comes from investments, which are often taxed at lower rates than ordinary wages and salaries.

What's more, some perfectly legal tax code provisions allow taxpayers to reduce their investment tax bills even further.

Of course, the wealthy aren't the only ones who enjoy what Obama refers to as "loopholes and shelters." Anyone who deducts their mortgage interest, saves money for retirement, realizes a capital gain or loss, or gets health insurance from their employer is enjoying a tax break.

Bush tax cuts: The real end game

The difference is that the rich use a broader array of tax-preferred investments, such as partnerships. Or they may invest in dividend-paying foreign stocks and can claim a foreign tax credit for the tax withheld from them by the foreign government.

Typically, too, the wealthiest are more likely to be retired or self-employed and are in a position to make big charitable contributions -- all of which come with distinct tax advantages.

And the wealthy can afford to be more risk-averse and park a lot of money in bonds, often tax-free.

To Obama, the fact that the wealthy can so whittle down their tax burden is "the height of unfairness."

Fairness in the tax code is a real issue, but there is no absolute answer to the question "what's fair?" And that's one reason why reforming the tax code will be a tough fight.

Earlier this fall, Obama proposed what he dubbed the Buffett Rule, named after billionaire investor Warren Buffett, who has urged Congress to tax the rich more.

The Buffett Rule is intended as a guiding principle for tax reform to ensure that millionaires pay a higher percentage of their income in federal taxes than those who make less.

That may not be as easy to implement as it sounds.

But one thing is a sure bet: The president will be sounding the theme many times over in his re-election bid.

BP Faces New Round Of Citations For Gulf Oil Spill







On Wednesday, the Bureau of Safety and Environmental Enforcement (BSEE) served BP with five new citations for regulatory violations arising from operations during the spill that sent over 200 million gallons of crude oil into the Gulf of Mexico.

Although businesses and ecosystems along the Gulf Coast are still in shambles, BP is trying to put the whole nasty ordeal in the past. In fact, the company has already resumed deepwater drilling operations in the Gulf of Mexico.

Although BP would love to forget its role in the worst environmental disaster in American history, it’s legal trouble stemming from the Deepwater Horizon explosion are far from over.

The newest violations were issued as Incidents of Non-Compliance (INC). A total of five INCs were issued by faxed letter to BP; four of the INCs were violations of one regulation in different sections of the well.

“Our federal regulations exist to ensure safe and environmentally-responsible activities. We will continue to be vigilant in enforcing those regulations,” said BSEE Director James Watson. “Further review of the evidence demonstrated additional regulatory violations by BP in its drilling and abandonment operations at the Macondo well.”

BP spokesman Scott Dean said the British company would appeal all the violations. He said the issues raised in the latest citations “played no causal role in the accident.”

Earlier this year, regulators concluded that while Transocean and Haliburton shared some fault, it was BP’s continued violation of federal regulations, refusal to heed crucial warnings and an inattention to safety measures that was ultimately responsible for the Deepwater Horizon explosion that killed 11 rig workers.

BP has 60 days to appeal the citations, after which the BSEE will consider the imposition of civil penalties.
