Felony weapons charge for student who brought fishing supplies to school

The arrests of several students who unwittingly and accidentally violated school weapon policies has some Georgian lawmakers saying “zero tolerance” makes zero sense.

A Cobb County high school senior was charged with the felony of bringing weapons into a school zone after police found fishing knives in a tackle box in his car. Cody Chitwood, a 17-year-old student at Lassiter High School and avid fisherman, turned himself in and was released on $1,000 bond.

Police were performing a random sweep, and drug-sniffing dogs detected black powder in Chitwood’s car. The powder was residue from a firecracker that had been in the car since Fourth of July, but it was enough to a warrant a full search that turned up the fishing-related weaponry.

“It’s pretty ridiculous,” said Chitwood in a statement to The Marietta Daily Journal. “I have an attorney and I’m hoping to get the felony dropped so I can still get in the Air Force.”

If the district attorney decides to prosecute, Chitwood could face two to 10 years in prison and a $10,000 fine.

Lassiter High School did not immediately respond to a request for comment.

Andrew Williams, a senior at nearby Allatoona High, received an identical felony charge after an assistant principal searched his car and found a knife. The official conducted the search after another student suggested that Williams had been smoking marijuana in his car. No drugs were found — just the knife.

Several state legislators say enough is enough.

“The public expects the same good common sense they use every day of their lives to apply to the laws of our state, and we as legislators seek nothing less,” said Republican state Rep. Ed Setzler, in a statement to The Marietta Daily Journal. “We’ll inspect the current state of the law, but our school leaders don’t like it, our law enforcement doesn’t like it, and we’re finding out the citizens who understand the current state of the law certainly don’t like it.”

Zero tolerance policies, overzealous prosecution of weapons violations and general gun hysteria have landed hundreds of unwitting kids in big trouble. Two Virginian seventh graders were recently expelled after playing with airsoft guns on private property near a school bus stop. Yet, like many other Bay Area residents who pay for their own medical insurance, they were floored last week when they opened their bills: Their policies were being replaced with pricier plans that conform to all the requirements of the new health care law.

Vinson, of San Jose, will pay $1,800 more a year for an individual policy, while Waschura, of Portola Valley, will cough up almost $10,000 more for insurance for his family of four.

“Welcome to the club,” said Robert Laszewksi, a prominent health care consultant and president of Health Policy and Strategy Associates in Virginia. [...]

Health emergency: On eve of Obamacare, Britain’s NHS needs political therapy

…Though the NHS has been subject to an endless stream of reorganizations and reforms over the decades whenever the government has transferred power, no prime minister – not even “Iron Lady” Margaret Thatcher - has had the political will to make fundamental changes. As Nigel Lawson, chancellor of the exchequer under Thatcher, famously put it, “The NHS is the closest thing the English have to a religion.”

…While it remains politically suicidal to campaign for major changes to the NHS, it is starting to become more acceptable to criticize it – if not publicly, at least socially and around the family dinner table. Younger, Internet-savvy generations with better access to information are more willing to question the authority of the medical establishment and push for choice than earlier generations who happily followed the orders of doctors and nurses.

In recent years, the institution has been besieged by a succession of major scandals, notably by the one at Stafford Hospital brought to light by Julie Bailey.

Bailey was an unlikely candidate to gain notoriety as a whistleblower against such a cherished institution. “Seven years ago, Mum and I were proud of the NHS,” she recounted. “So when we went into Mid Staffs [hospital], it was a huge shock to find what we did.”

A former social worker and lifelong liberal, Bailey lived in Stafford, a town 140 miles northwest of London, where she took care of her mother, Bella. In the fall of 2007, her mother was hospitalized at Stafford Hospital after a rough, sleepless night interrupted by coughing and retching.

Once in the hospital, Bailey was bullied by staff members and dismissed when she suggested her mother needed medication for a chest infection. One night, her mother was left lying in her own vomit, despite screaming for help. Onedoctor told Bailey that her mother would die a “painful death,” snapping his fingers for emphasis.

Her confidence shaken, Bailey took to sleeping on a hard plastic chair in the hospital to attend to her mother’s care. But spending more time in the hospital meant being exposed to the depth of its horrors. “What I saw was the abuse of vulnerable adults,” she said.

Bailey said she witnessed nurses leaving food out of reach of immobile patients who couldn’t feed themselves. Sometimes, nurses would come by to say they forgot the keys to the drug cabinet, meaning they couldn’t distribute medication to those in need of it. Patients who required assistance going to the bathroom were often forced to relieve themselves in their own beds. Desperate patients deprived of fluids resorted to drinking water out of the dirty flower vases in the hallway. “One of the worst things was walking down the corridor,” she recalled, “and it would just be, ‘Nurse! Nurse! Help! Help!’ ” More mobile patients would often wander around the hallways, confused, in a futile search for care.

…Even as she recounted the story six years later, she broke down in tears.

“It’s still something I don’t think I’ll ever get over,” she said. “Seeing that despair, I don’t think I will. So when I came out, I just knew I had to do something, because I had left these people behind.”

…Typically, when people need health care in the U.K., they visit general practitioners, who serve as gatekeepers who will either treat patients directly or refer them elsewhere, depending on the diagnosis. Because doctors are on salary and typically aren’t very worried about the threat of lawsuits, they have little incentive to order tests that may prove unnecessary. In 2010, just 41 MRIs and 77 CT scans were performed per 1,000 people in the U.K., according to OECD data, compared with 98 MRIs and 265 CT scans per 1,000 in the U.S.

The drawback of such an approach is that because the system prides itself on creating equity by putting the needs of society as whole ahead of any given patient, it means that the needs of individuals often get lost in a sea of managers, administrative targets and rationing decisions.

…Individuals cannot get tests within the NHS if its doctors don’t approve them. The National Institute for Health and Care Excellence (whose acronym NICE is a source of irony to critics), a board of experts that recommends treatments based on cost-benefit analyses, can deny cancer patients drugs if it concludes that a short extension of life isn’t worth the expense. In a further bit of irony, NICE was created in the 1990s to foster equality within the system because certain drugs were more available in some regions of the country than others.

The NHS is rife with examples of centralized policies producing real-world results that range from tragic to absurd.

For instance, the former Labor government responded to complaints about waiting times at hospital emergency rooms by instituting a target for NHS hospitals to treat patients within four hours. Under pressure to meet these targets, the Daily Mail reported in 2008, hospital administrators let seriously ill people wait in ambulances for hours outside the hospital so that they weren’t technically counted as patients. As a result, the ambulances weren’t available to answer emergency calls. LINK

CBS Hounds Pelosi Over Shutdown: 'You've Called Them Arsonists'

CBS This Morning has a long established history of conducting softball interviews of liberal/Democratic guests,while unleashing on conservative/liberal ones. But on Friday, the morning newscast surprisingly hounded Rep. Nancy Pelosi on the ongoing government shutdown. Obama supporter Gayle King repeatedly pressed Pelosi about "people [who] are just saying...work it out....both sides have to be willing to leave something on the table."

Anthony Mason underlined how "Senator [Harry] Reid called some Republicans anarchists. You've called them arsonists....How do you get a meeting of the minds when people are talking like that?" Norah O'Donnell also wondered about "a scenario...where Democrats would be willing to give on a larger budget deal – the grand bargain coming back, and giving on entitlements, so that we can move forward." O'Donnell led with the Thursday security scare at the Capitol, and raised the subject of the shutdown by asking, "Is it true the Capitol Police are working without pay because of the budget shutdown?" Once the San Francisco liberal confirmed that this was the case, King began pursuing her about her role in the shutdown:

GAYLE KING: ...What do you say to people that say, just work it out, without going into the tit for tat that seems to be going on both sides? What will it take, Madame Speaker, to resolve this issue?

REP. NANCY PELOSI, (D), HOUSE MINORITY LEADER: Well, it will take some – coming together on the Republican side. It's very hard to negotiate with the Republicans when they can’t negotiate with themselves. But having said that-

KING: I know, but they're saying the same thing about you guys, too.

PELOSI: No, it isn't; no, it isn't. We have – four times – brought to the floor their bill and voted 100 percent for their bill, and they still won't take yes for an answer. But let's take a deep breath on this. We have a serious matter. Our government is shut down. The – the default on our full faith and credit is at risk. And so, we have to find a path. And so, we have...said to the Speaker, we will accept your bill – we don't like the bill....But we will accept that in order to go forward. But they do not have, within their own ranks, the ability to take yes for an answer-

KING: I know. A good friend of mine said, in any negotiation, both sides have to be willing to leave something on the table.

PELOSI: That's right, and that's why we agreed to their number...which we don't like. We've always said to them, we'll help you procedurally; we'll help you substantively....

Mason continued with his citation of Harry Reid and Pelosi's name-calling. The former House Speaker answer by launching more attacks against her Republican opponents:

PELOSI: Well, the fact is that there are, within the ranks of the Republican Party – and this is the bigger picture that the Republican Party has to deal with, and has an impact on our country – if you don't believe in a government role, then it's easy for you to say, in order to lift the debt ceiling, we want to eliminate all EPA rules for clean air, clean water, and the rest....You have to come to a conclusion. Sandy aid – fewer than 20 percent of the Republicans voted for Sandy aid. They have something going on there. I say Republicans, take back your party.

O'Donnell then asked her "grand bargain" question. Pelosi replied that "the President already has in the budget that he agreed to in 2011. That isn't a happy scenario for our members, but...nonetheless, it was part of a grand bargain, and it all depends on what the bargain is."

Near the end of the segment, King hounded her one more time, pointing out that Pelosi has "five children, and you're used to squabbling. In one sentence, what would you say to your children if they were behaving the way the Democrats and the Republicans are behaving?" The liberal guest replied by actually pointing a finger at the left-leaning press: "Well, I don't agree to your stipulation of behavior. The President of the United States has gone forward with – extending the hand of friendship over and over. I think that has been lost in the news."

Mason interrupted and shot back, "But, at the same time, the President's saying, we won't negotiate, and he's taking criticism for that." Pelosi stuck to her talking points, but King came right back: "To the people outside, it really just does seem like white noise. It just seems like, you say something; they say something...And the people are just saying, you guys, just work it out. That's all I'm saying."

NORAH O'DONNELL: The Capitol Police are working without pay right now because of the partial government shutdown.

Congresswoman Nancy Pelosi, the House Democratic leader, is here this morning. She was on Capitol Hill yesterday with other congressional leaders as the chase happened. Good morning.

REP. NANCY PELOSI, (D), HOUSE MINORITY LEADER: Good morning.

O'DONNELL: This was very scary yesterday when we first heard about these shot fired – shots were fired. You were inside the Capitol. Were lawmakers worried that they might be under attack?

PELOSI: Well, the responsibility of the Capitol Police – to protect the tourists, the visitors, the press, the members of Congress – is a large one, and high-tension wires go up, of course, when shots are fired. And so, I was on the floor. [Rep.] John Lewis came in, and – saying, they made us all come inside because of what's going on there. It wasn't later – until later that we learned what it was. It's very tragic – so sad.

O'DONNELL: Is it true the Capitol Police are working without pay because of the budget shutdown?

PELOSI: Yes, yes, yes. Well, hopefully, we can compensate them retroactively. But the capitol is open, people are coming – they need to be protected.

GAYLE KING: And what do you say to people that just – you know, every side has their own position. What do you say to people that say, just work it out, without going into the tit for tat that seems to be going on both sides? What will it take, Madame Speaker, to resolve this issue?

I want to remind you: yesterday was the fifth anniversary of the President signing the TARP bill – President Bush signing the TARP bill. It was a terrible situation. Government was in meltdown. We didn't approve of the Bush policies that got us there in the first place. We didn't even like the bill he sent us. But it was essential for our economy, and for our financial industry – for our services industry – for us to – to make that vote. The Republicans abandoned their own president, because they don't believe in a government role. We saved the day with 170 Democratic votes.

You have to – you have to come to a conclusion. Sandy aid – fewer than 20 percent of the Republicans voted for Sandy aid. They have something going on there. I say Republicans, take back your party.

O'DONNELL: I want to get to why you're here in New York, but very quickly first, do you see a scenario, though, where Democrats would be willing to give on a larger budget deal – the grand bargain coming back, and giving on entitlements, so that we can move forward?

PELOSI: Well, the President already has in the budget that he agreed to in 2011. That isn't a happy scenario for our – our members, but the – nonetheless, it was part of a grand bargain, and it all depends on what the bargain is. But our attitude – we go to the table saying that if you want to talk about the solvency of Social Security, talk about that, and that – all the money saved should go back into Social Security – and the same thing for Medicare.

I'm here today – and I'm excited about it, because we haven't – even though government is shut down, we still have to think and imagine new ways about how to make the future better.

O'DONNELL: So, you're here for a women's economic agenda. Tell us about that.

PELOSI: It's called, 'When Women Succeed, America Succeeds', and it's about women in the workplace. Three simple things: equal pay and raising the minimum wage – so pay equity; secondly, paid sick leave – earned, paid sick leave; and third, child care. We think that this would unleash the power of women in our economy – and men too. They need paid leave and sick – child care. So, we're very excited about the response we've received all over the country to this. And, by the way, it will lift our GDP by two or three points if women are more empowered.

KING: Before you go, Congresswoman, you have – you have five children, and you're used to squabbling. In one sentence, what would you say to your children if they were behaving the way the Democrats and the Republicans are behaving? What would you say?

PELOSI: Well, I don't agree to your stipulation of behavior. The President of the United States has gone forward with – extending the hand of friendship over and over. I think that has been lost in the news. But if you say to the President, we only will open [the] government if you eliminate the Affordable Care Act, that's just a non-starter.

MASON: But, at the same time, the President's saying, we won't negotiate, and he's taking criticism for that-

PELOSI: No, no, no, no. Here's what the President has said. The full faith and credit of the United States of America is not negotiable. Everything else in a budget is that. But they have to come – they can't say our first premise is, you have to overturn the Affordable Care Act. That's – think of yourself in your own lives. If you divorce – if you divorce your husband, we can have this conversation-

KING: I hear you so loud and clear, but to the people outside, it really just does seem like white noise. It just seems like, you say something; they say something; you say something; we say something. And the people are just saying, you guys, just work it out. That's all I'm saying.

PELOSI: I agree with you. I agree that it seems that way-

KING: Yes, yes. That's the way it is. Okay, okay-

PELOSI: But that doesn't mean that we fold when it comes to the well-being of our children. And what they are doing is really very, very harmful – have we'd gone forward. Having said that, let's find a path to get this done. The Speaker has said he wants to do something in a bipartisan way. I asked him as recently as yesterday, can we sit down and talk about that? Hopefully, we will be able to today after he meets with our caucus. But our caucus has agreed to their number. The President has been most open. But he's not going to have the full faith and credit of the United States-

O'DONNELL: Well, we'll be watching-

KING: Well, people can say you certainly know something about compromise. You just celebrated your 50th wedding anniversary, and that means compromise!

MASON: Congratulations!

PELOSI: It means happiness-

Sheila Jackson Lee on continuing resolution: 'We have martial law' (Video)

On Monday, Rep. Sheila Jackson Lee, D-Texas, said from the floor of the House of Representatives that America is now undermartial law because of the continuing resolution.

"This is not an idea of anyone over another person. Republican and Democratic Senators have already voted for this clean bill that we could vote on today. We have martial law. What that means--and my colleagues know what it means--is that you can put a bill on in just minutes," she said.

Jackson Lee's startling comments received absolutely no mention from the so-called "mainstream media," but was picked up Wednesday by several "new media" outlets, including WND.com.

'The comments from Rep. Sheila Jackson Lee, D-Texas, took some listeners by surprise, since a common understanding of “martial law” would be of an authority – a president or a military commander – using military force to impose its will on an uncooperative people," WND said. "Think tanks, machine guns and jail cells."

A post at Washingtonsblog observed: “The last time we heard Congress members use the phrase martial law was when Congressmen Brad Sherman and Paul Kanjorski, and Senator James Inhofe, all said that Treasury Secretary Hank Paulson warned of martial law if the TARP banks bailouts weren’t approved.”

Paul Joseph Watson said that when used in legislative context, the term is somewhat obscure, but has been used before to define lawmakers’ ability to “fast track” legislation without going through the usual congressional process.

But, he said, her call for "martial law" would appear to conflict with Article I, Section 7, Clause I of the Constitution, which specifically states that, “All Bills for raising Revenue shall originate in the House of Representatives.” The resolution Jackson Lee spoke of came from the Senate.

The Texas Democrat who was once dubbed the "Congressional boss from Hell," also accused Republicans of forcing people to decide “amongst your children which ones to feed,” WND added.

Others, however, might believe that America is on the verge of martial law, given the heavy-handed tactics used by the National Park Service since the partial government shutdown began last week.
