Alabama chief justice orders halt to same-sex marriage licenses

(Reuters) - The chief justice of the Alabama Supreme Court ordered the state's probate judges on Wednesday not to issue marriage licenses to same-sex couples, despite a ruling by the U.S. Supreme Court last year legalizing gay marriage.

Chief Justice Roy Moore said judges have a duty to uphold the state's law banning same-sex marriage while the Alabama Supreme Court weighs the effect of the national ruling on the state.

Legal experts and gay marriage activists rebuked the directive, noting the landmark U.S. Supreme Court decision last June provided same-sex couples the right to marry in all 50 states.

A federal judge in Alabama also overturned the state's ban on same-sex marriage last year.

"Roy Moore has advised the probate judges to do something that would be in contempt of court," said Richard Cohen, president of the Southern Poverty Law Center. "It's going to be ignored."

One probate judge, Steven Reed in Montgomery, Alabama, said he would not heed the administrative order.

"Judge Moore's latest charade is just sad & pathetic," Reed posted on Twitter.

Moore wrote in his order that the U.S. Supreme Court ruling was at odds with a decision last March by the Alabama Supreme Court that instructed probate judges to stop issuing marriage licenses to same-sex couples.

The conflicting opinions had resulted in "confusion and uncertainty," Moore said, with many probate judges issuing marriage licenses to gay and lesbian couples while others refused to do so.

"This disparity affects the administration of justice in this state," he wrote.

Until the Alabama Supreme Court decides the matter, probate judges "have a ministerial duty not to issue any marriage license contrary" to the state's law banning same-sex marriage, Moore said.

A lawyer for Kentucky county clerk Kim Davis, who spent six days in jail in September for contempt of court after refusing to sign gay marriage licenses, applauded Moore's stance.

"The opinion of five lawyers on the U.S. Supreme Court regarding same-sex marriage is lawless and without legal or historical support," Mat Staver, chairman of the Liberty Counsel legal group, said in a statement.

Moore, a Republican, has been a hero of conservative causes before. In 2003, he was removed from office after a federal judge ruled he was placing himself above the law by refusing to take down a Ten Commandments monument.

He won the chief justice job back in 2012, vowing not to do anything to create further friction with the federal courts.

BALTIMORE (Reuters) - A Maryland judge on Wednesday ordered a Baltimore police officer to testify against other officers charged in the death of detainee Freddie Gray.

A lawyer for the officer, William Porter, said he would seek an appeals court injunction to block Porter from testifying against Officer Caesar Goodson Jr. and Sergeant Alicia White.

Baltimore City Circuit Court Judge Barry Williams said Porter, whose own trial ended in a hung jury last month, could be compelled to take the stand since state prosecutors had offered him immunity in exchange for testifying.

Williams said during a pre-trial hearing that Porter's "extremely important testimony is needed in the Goodson and White cases."

Goodson is the second of six officers scheduled to stand trial for Gray's death in April and faces the most serious charge, second-degree depraved-heart murder. The trial is set to begin on Monday with jury selection.

The 46-year-old officer, who like Gray is black, was the driver of the van where Gray, who was arrested after fleeing police, sustained the broken neck that killed him.

The majority black city of 620,000 people exploded in arson and rioting after Gray's funeral. The unrest followed other police killings of black men in cities including New York and Ferguson, Missouri.

Porter's own trial on involuntary manslaughter and other charges ended in a mistrial last month and a retrial is set for June.

Williams issued his order after denying a defense motion to quash a subpoena forcing Porter to testify. Porter took the stand to say that he would invoke his constitutional right against self-incrimination if called to testify.

Porter's lawyers said that if he is forced to testify, material could emerge that could be used against him in retrial.

Doug Colbert, a University of Maryland law professor, said of Williams' decision, "This is a straightforward ruling. The government has the power to compel testimony if they offer immunity."

Goodson faces up to 30 years in prison if convicted of the murder charge. In Maryland, "depraved-heart" murder is a killing done while acting with extreme disregard for human life.

He also is accused of manslaughter, assault, misconduct in office and reckless endangerment.

Williams also denied a request from Goodson's lawyers to move the trial out of the city due to the intense publicity surrounding the case.

It's been days since a group of armed militiamen stormed onto a federal wildlife refuge inOregon and refused to leave. Now, the group's got a bone to pick with what they think is the media's negative portrayal of them.

"The Black Lives Matter movement, they can go and protest, close freeways down and all that stuff, and they don't get any backlash, not on the level that we're getting," one man told reporters on Monday, according to the Huffington Post. But even before the man's comment, observers noted that the militiamen were absolutely not being treated the same as black protesters:

Did I miss the call for the national guard in Oregon? I recall them in Ferguson and Baltimore.


One CNN commentator, Art Roderick, racialized the moment even further. "What are they actually doing? They're not destroying property; they're not looting or anything," he said on-air.

To be sure, Black Lives Matter activists have used an assortment of tactics to bring attention to their cause. During the holidays, the network staged a series of freeway and airport shutdowns to disrupt business as usual and highlight the black families that did not celebrate Christmas with their slain loved ones. Those tactics, and many others, continue to be hotly debated.

But by and large, Oregon's militiamen have been deemed a nuisance, not a threat.

Physicians In France Join Growing List Of Doctors Who Question Vaccine Safety: Mainstream Media Blackout

There have been a number of articles floating around the internet claiming that France is opting out of vaccines. I could not find a credible source to back up this information, however, and from what I’ve examined, it does not seem to hold true. There is, nevertheless a demonstrably harsh resistance to vaccines among the general population and a significant portion of their doctors, as noted in a recent study published in 2015 that goes into more detail.

Before going into detail about France and vaccines, it’s important to note the following prior to reading:

Questioning vaccine safety can be met with sharp criticism in return, despite the fact that a number of countries have a very limited vaccine schedule compared to the Western world. Critics also seem to ignore the fact that many scientists and doctors around the world are presenting information and publishing papers (in reputable, peer-reviewed journals) which outline the science behind these concerns. On the other hand, we have a number of doctors and scientists publishing papers in the same journals which completely support the mass administration of vaccines. It remains a divisive issue to be sure.

It is difficult to ignore things like the suspension of multiple vaccines in multiple countries (like the HPVvaccine), however. This is precisely why we published “The Top 6 Reasons Why Parents Are Choosing Not To Vaccinate Their Children.” This side of the debate, and its attendant research, is rarely (if ever) publicized, and we at CE believe that everyone has the right to this information so that they can make an informed decision about whether or not to vaccinate.

One of the biggest concerns with vaccines is their adjuvants. These substances have been added into vaccines for almost one hundred years now, yet the Food and Drug Administration (FDA) and vaccine manufacturers have not conducted appropriate toxicity studies or testing to prove their safety. Vaccine adjuvants, such as aluminum, for example, have been put into vaccines based entirely on the assumption that they are safe. (source) It would really be great to see a study conducted that examines the health of vaccinated vs. non vaccinated populations…

One example out of many where concern is raised (about adjuvants) comes from a fairly recent Meta-Analysis published in the journal Bio Med Research International. The study found that:

As seen in this review, the studies upon which the CDC relies and over which it exerted some level of control report that there is no increased risk of autism from exposure to organic Hg in vaccines, and some of these studies even reported that exposure to Thimerosal appeared to decrease the risk of autism. These six studies are in sharp contrast to research conducted by independent researchers over the past 75+ years that have consistently found Thimerosal to be harmful. As mentioned in the Introduction section, many studies conducted by independent investigators have found Thimerosal to be associated with neurodevelopmental disorders. . . . Considering that there are many studies conducted by independent researchers which show a relationship between Thimerosal and neurodevelopmental disorders, the results of the six studies examined in this review, particularly those showing the protective effects of Thimerosal, should bring into question the validity of the methodology used in the studies. Here is another published in the Journal of Inorganic Biochemistry, and here is one of the most recent examples – a paper that was published in 2015 in the journal Frontiers In Neurology which emphasizes various concerns about aluminum in vaccines:Again, These are just a few examples of many that contradicts previous studies claiming that vaccine adjuvants are completely safe.

France & Vaccines

A number of experts in various countries have also expressed their concern over the safety of several vaccines. As mentioned above, Gardasil is a great example, having been banned in Japan and in multiple countries in Europe.

If there are problems with vaccines, rest assured they are not going to be televised by corporately owned media. After all, it’s not like you are going to bash your own products on your own television stations, are you? (A perfect example of this is the story of senior CDC scientist doctor William Thompson, which you can read more about here.)

This is why most of you reading this might not know how deep the vaccine controversy actually goes, especially if you rely on mainstream media as your only source of information, without doing any investigation for yourself.

A new study published in the journal EbioMedicine outlines this point, stating in the introduction:

Over the past two decades several vaccine controversies have emerged in various countries, including France, inducing worries about severe adverse effects and eroding confidence in health authorities, experts, and science (Larson et al., 2011). These two dimensions are at the core of the vaccine hesitancy (VH) observed in the general population. VH is defined as delay in acceptance of vaccination, or refusal, or even acceptance with doubts about its safety and benefits, with all these behaviors and attitudes varying according to context, vaccine, and personal profile, despite the availability of vaccine services (Group, 2014, Larson et al., 2014, Dubé et al., 2013). VH presents a challenge to physicians who must address their patients’ concerns about vaccines and ensure satisfactory vaccination coverage.

The study concludes with the observation that “after repeated vaccine controversies in France, some vaccine hesitancy exists among French GPs, whose recommendation behaviours depend on their trust in authorities, their perception of the utility and risks of vaccines, and their comfort in explaining them.”

As a result, the study outlines how “up to 43 % of GPs sometimes. or never, recommend at least one specific vaccine to their patients.”

The percentages differ because the study was broken down as to which vaccines, and whether they are recommended never, sometimes, often or always. You can refer to the study for more details.

The authors’ overall findings “suggest that VH [vaccine hesitancy] is prevalent among French GPs. It may make them ill at ease in addressing their patients’ concerns about vaccination, which in turn might reinforce patients’ VH.”

Again, this isn’t a secret, another study (out of many, cited in the France publication) outlines how “more research is needed to understand why some health professionals, trained in medical sciences, still have doubts regarding the safety and effectiveness of vaccination.” (source)

Why Physicians Are Having Trouble Trusting Health Authorities

The academic institutions of this country are allowing themselves to be the paid agents of the pharmaceutical industry. It’s good to see a paper like this finally officially acknowledging the trust issues that some physicians are starting to have when it comes to pharmaceutical grade products. This would have been virtually unheard of just a few short years ago, and it is refreshing to see so many influential and big names in medicine starting openly question the industry.

Dr. Richard Horton, the current Editor-in-Chief of the Lancet – considered to be one of the most well respected peer-reviewed medical journals in the world — recently stated that the “case against science is straightforward: much of the scientific literature, perhaps half, may simply be untrue. Afflicted by studies with small sample sizes, tiny effects, invalid exploratory analyses, and flagrant conflicts of interest, together with an obsession for pursuing fashionable trends of dubious importance, science has taken a turn towards darkness.” (source)

Dr. Marcia Angell, a physician and longtime Editor-in-Chief of the New England Medical Journal (NEMJ), which is considered to be another one of the most prestigious peer-reviewed medical journals in the world, expresses the same view:

It is simply no longer possible to believe much of the clinical research that is published, or to rely on the judgment of trusted physicians or authoritative medical guidelines. I take no pleasure in this conclusion, which I reached slowly and reluctantly over my two decades as an editor of the New England Journal of Medicine. (source)

There are countless examples of this type of fraud, the most recent having to do with the anti-depressant drug Paxil. You can read more about that here. I just wanted to emphasize that we have real-world proof that goes beyond these types of statements. Medical fraud is a huge topic on its own and hopefully I have provided a small base for you to further your own research.

Government Chemist Tampered With 40,000 Cases, Locking Countless Innocent Americans In Prison

UPDATE 1/3/16 – Multiple Victims Don’t Know They Were Affected by the Fake Lab Results

Years after government chemist Annie Dookhan faked evidence against thousands of Americans, there is still a long trail of lives she destroyed, and the government is evidently not cleaning up the mess.

Disturbingly, there are still numerous innocent people locked in prison, and they might not have any idea that it was Annie Dookhan who brought about the horrible fate they now face, day after day, year after year, stuck there with no hope of getting out.

Imagine being locked in a cell and knowing you’re innocent. Imagine how you’d feel as you watch the prime years of your life taken away from you — all because of a vicious government chemist, along with the low-IQ cops who willingly enforce the corrupt “war on drugs.”

There might be thousands of Americans in precisely this situation right now, and they have no idea what Dookhan actually did.

The Boston Globe reports as follows:

Incredibly, more than four years after Dookhan’s crimes were first uncovered, this simple question of justice remains unresolved. Thousands of those whose lives were affected haven’t been notified of their rights, including the possibility of a new trial. Many still have no idea they are Dookhan defendants.

The mess isn’t even close to being cleaned up. And what a mess it is.

MASSACHUSETTS — In a maddening scandal that is rocking the state of Massachusetts, a government crime lab chemist has been caught intentionally forging signatures and tampering with evidence in as many as 40,000 cases, destroying the lives of countless innocent Americans.

Annie Dookhan worked as a chemist for the State of Massachusetts, and it turns out she had close relations with prosecutors.

These prosecutors were able to successfully convict innocent Americans because Dookhan would chemically taint the “evidence,” resulting in career boosts for the prosecutors while innocent men and women were torn from their families and locked in cells.

Prosecutors praised Dookhan’s work and depended on her to get the convictions they wanted, according to reports.



Hundreds of “convicts” and defendents have already been released, and there are potentially thousands more waiting to be set free.

Dookhan used her position to forge results for nearly a decade. “I don’t think anyone ever perceived that one person was capable of causing this much chaos,” said Norfolk County District Attorney Michael Morrissey.

“You can see the entire walls full of boxes… in one of these cardboard boxes, there could be hundreds of cases … in each box,” said Morrissey.

Hundreds of defendants and “convicts” had been arguing that they were framed and claiming that the evidence used to convict them was mishandled. They were right.

In one recent case, a man was charged with “selling cocaine and heroin.” His public defender, Julieann Hernon, believes that this man was a potential victim of Dookhan’s fake evidence and ought to be released.

“[Dookhan] was mis-testing evidence, dry-labbing evidence, saying she had ‘conducted tests’ when she had not, deliberately tainting drugs,” said Hernon.

“Certainly, I think, we have to presume a taint here when Annie Dookhan was the chemist in the case,” said Hernon.

In another recent case, defense attorney William Sullivan was able to successfully reverse his client’s prior “guilt” because Dookhan was the secondary chemist involved in the conviction.

“This is a lab that was pretty much wholly and fully contaminated by Ms. Annie Dookhan,” Sullivan told the judge. “She had full access to everyone’s drugs.”

While many have been set free, they will never get the lost years of their lives back.

“The tragedy is that my client already did four years on this,” said Sullivan. “I mean, that is disturbing in itself.”

Many other innocents have lost their careers, lost their children, and lost their marriages.

Michael Morrissey, Norfolk County District Attorney, is now sifting through thousands of files to find out which should be thrown out because of Dookhan’s corruption and deceit.

In federal court, many innocents received even harsher sentences due to prior convictions based on Annie Dookhan’s fake “evidence.”

Several civil suits are getting started by those accused of crimes based on Dookhan’s tampering, accusing Dookhan of trampling on their rights to fair trials.

“I screwed up big time. I messed up. I messed up bad. It’s my fault. I don’t want the lab to get in trouble,” Dookhan was reported as saying.

Of course, Dookhan’s “screw up” — a “screw up” that she intentionally committed for nearly a decade — will never bring back the lives that have been destroyed.

In analyzing Dookhan’s career, it was found that she also routinely invented fanciful job titles for herself. Examples include “special agent of operations” and “on-call terrorism super­visor.” She would testify in court as an “expert.”

She maintained her composure year after year as innocents were bound and forced into prison cages.

The relationships she had with prosecutors are also under scrutiny. Dookhan once told a prosecutor in an email that she couldn’t use her expert testimony at a trial. The prosecutor replied, “No no no!!! I need you!!!”

Was the prosecutor intentionally depending on Dookhan’s deception to score a conviction and a career boost?

Many of the prosecutors became devoted fans of Dookhan and wanted to take her out for drinks, saying she was on their “dream team.” The Boston Globe provided an email between Dookhan and a prosecutor with whom she had a particularly friendly relationship:

“Glad we are on the same team,” he once wrote Dookhan — including one day in May 2010 when he told her he needed a marijuana sample to weigh at least 50 pounds so that he could charge the owners with drug trafficking.

“Any help would be greatly appreciated!” he wrote, punctuating each sentence with a long string of exclamation points. “Thank you!”

Two hours later, Dookhan responded: “OK . . . definitely Trafficking, over 80 lbs.” ­Papachristos thanked her profusely.

Boston attorney David Meier found that in Dookhan’s nine-year government position,over 40,ooo people may have had their cases tainted by Dookhan.

But the devastation done to families is impossible to calculate.

Dookhan is now facing charges of her own. If she is convicted she will receive a relatively light sentence of three to five years, which has outraged citizens even more.

UPDATE (11/29/13):

Dookhan has plead guilty to all the counts brought against her. As expected, she was given a three to five year sentence.

“Sadly, the saga continues for the thousands of individuals who have borne the impact of Dookhan’s misdeeds, and the lab’s scandalous management,’’ says Anthony Benedetti, chief counsel of the state public defender agency.

Dookhan showed no emotion as the impact of her actions was described in court,according to a report.

So far, more than 600 people have had their convictions deleted or set aside. More than 300 people have been released from captivity, with potentially thousands more still waiting to be set free.

Many citizens question how Dookhan was able to do this for nearly a decade without being detected by anybody.

A writer to the Boston Globe asks, “Indeed, where were her supervisors and those responsible for checking and approving her work? Why were no red flags raised at the speed with which Dookhan completed tests and submitted reports?”

Martin W. Healy, general counsel for the Massachusetts Bar Association is conducting an ongoing investigation into the lab.

“This is one chapter in a continuing saga,’’ Healy said. “The legal community and the general public still have a number of unanswered questions about what’s gone on here. How deep was the problem? Is it really just isolated to Dookhan or does it go beyond that?’

Dookhan is currently in protective custody at the state women’s prison in Framingham but will likely transition to the prison general population soon, according to her attorney.

UPDATE (03/07/14): Dookhan scandal was part of larger “pattern” at drug lab — over two thousand additional cases now in need of review

Ongoing investigations have revealed that what Dookhan did was part of a larger “pattern” of neglect and deficient protocols, according to a new report by the Boston Globe.

Around 2,300 new cases were found to contain incompatible evidence but made it past prosecutors and defense attorneys anyway.

That is over two thousand additional times, we are told, that “neglect” happened at the lab.

A more rational explanation might be that it was premeditated and intentional as part of a scheme to make money locking up innocent people.

“The report found what we have been saying all along: The entire lab was a problem,” said Anthony Benedetti, chief counsel of the public defender agency.

In all, there were at least 46,000 cases that Dookhan handled, according to the Boston Globe.

She was convicted for tampering with evidence by manipulating substances and falsely declaring their status, along with lying about her “chemistry” credentials.
