Porn Production at Standstill after Actress Tests Positive for HIV

Nightline Fix

It's a multibillion dollar industry, some estimate bigger than professional baseball, football and basketball combined.

But now the adult entertainment industry is at a standstill because another performer has tested positive for the AIDS virus.

Adult film actress Cameron Bay has worked in the industry since 2010, not even on a regular basis. But her career is on hold. She tested positive for HIV. Her diagnosis has halted all porn production. So far, no other actors she's worked with have tested positive, but performing in porn can mean taking your life into your own hands.

“Animals have more protection in the making of films than porn performers,” said Michael Weinstein, president of the AIDS Healthcare Foundation. “How many cases do there have to be before we take it seriously?”

Gina Rodriguez, a former porn actress, quit the business in part because of the fear of disease.

“You know, I think it's a ticking time bomb,” she said. “It really is. It's going to get worse. It's not going to get any better.”

This has happened before. In 2010, a porn actor's HIV test came up positive. The industry adopted some safeguards, requiring all performers to get an HIV test once a month. California's division of occupational safety and health, the same group that requires construction workers to wear hardhats, also requires the adult film industry to protect workers from hazards associated with blood-borne pathogens. The regulations clearly state employers must provide and ensure employees use appropriate personal protective equipment, including condoms, dental dams, gloves and eye protection. But those rules are rarely enforced. The industry itself has been rigorous about HIV testing, but not about condom use.

And it seems to have everything to do with money. Steve Hirsch, CEO of Vivid Entertainment, one of the biggest producers, spoke with “Nightline” in 2009.

“The truth is that when people watch adult movies they are watching it for the fantasy,” explained Hirsch. “They don't want to see condoms. Condoms in adult movies just don't sell as well. That's just a fact.”

The AIDS Healthcare Foundation spearheaded a measure requiring condom use in L.A. County. It passed in November of last year.

The porn industry sued to overturn this decision, saying it was unconstitutional. But a federal judge recently rejected their claim. But still, of the major adult entertainment producers, only one studio requires condom use for all their contract stars: Wicked Pictures.

“Most of the companies frown upon it,” said Rodriguez, the former porn actress. “If you're coming in saying, ‘You know, I want to wear a condom,’ chances are they're going to take the girl that's going to do it without the condom.”

She is thankful she made it out of the business with a clean bill of health.

Miley Cyrus’s Outrageous VMA Performance Shocks … Everyone

Stop The Presses!15 hours ago

Miley Cyrus didn't blur the line, she straight up crossed it.

Watch video

The 20-year-old's raunchy, childhood-crushing performance at the MTV Video Music Awards on Sunday didn't just elicit a negative reaction on social media, it has also riled Thicke's mother, the Parents Television Council, Kelly Clarkson and even liberal-minded celebs including the oft-scantily clad Brooklyn Decker and rebel rousers Bill Maher and Judd Apatow.

After watching the performance, Gloria Loring, Thicke's mother, said she didn't understand what Cyrus was trying to do. "I was not expecting her to be putting her butt that close to my son," she told omg! Insider.

She regrets ever seeing the VMA footage. "It's not that I saw it once, it's that I can never un-see it," she said, adding that she does not think that Cyrus's new incarnation is a beneficial move.

Miley Cyrus at the 2013 VMAs (Getty Images)The Parents Television Council issued a statement blasting MTV for "marketing sexually charged messages to young children using former child stars."

Relating specifically to Cyrus's crude stage show, during which she simulated sex acts at every turn (grabbing her crotch, sticking out her tongue, bending over in front of Robin Thicke, and acting inappropriately with a foam finger) as she pranced around in a nude bikini, PTC Director of Public Policy Dan Isett said, "MTV continues to sexually exploit young women by promoting acts that incorporate 'twerking' in a nude-colored bikini. How is this image of former child star Miley Cyrus appropriate for 14-year-olds?"

Paul Porter, who is an Advisory Board Member for PTC (which was also unhappy with Lady Gaga's barely-there shell ensemble and the condom ads that ran throughout the show), said, "The Miley Cyrus/Robin Thicke performance simply substituted talent with sex. … Heads should roll at MTV.”

Criticism of Cyrus's two-song act, during which she barely sang, wasn't limited to PTC – Twitter was on fire.

Season 1 "American Idol" winner Kelly Clarkson conveyed her disappointment with some of the night's performers, posting on Twitter, "Just saw a couple performances from the VMA's last night. 2 words.... #pitchstrippers."

Brooklyn Decker spoke for many when she wrote:

James Van Der Beek was as uncomfortable with the foam finger as the rest of the audience:

Bill Maher showed his trademark sense of humor:

As did Judd Apatow:

Any dreams Mariah Carey and Nick Cannon's young kids may have had for showbiz have already been ruined:

And Arie Luyendyk Jr. touched on a topic many were wondering about – where exactly Cyrus's fiancé, Liam Hemsworth, was during all of it:

Of course famous folks weren't the only ones commenting. Here were a few others of the most memorable tweets:

Two people who weren't shocked by what they saw? Cyrus's own parents, Billy Ray and Tish, who recently called off their divorce for the second time. Tish jumped to her feet and gleefully applauded her little girl as soon as the performance ended, looking every bit the proud mom.

Transgender Woman Dies After Beating in Front of NYPD Precinct

Takepart.com

Islan Nettles was out in New York City with friends when a group of young men approached her, learned she was a transgender woman and began taunting and maliciously beating her—right in front of a police precinct in Harlem.

The fashion design student with delicate features was punched in the face, knocked to the ground and beaten until she lost consciousness on the night of August 16.

“They were called f****, they were called he-she’s, she males, things of that nature,” Nettles’ mother told a local newscast.

Islan Nettles, born Vaughn Nettles, fell into a coma she would never awake from. She died Thursday after being taken off of life support. She was only 21.

The site of the violence, near a police station, highlights a startling increase in crimes against the LBGT, and what some view as a historic lack of police sympathy for crimes against the community.

Nettles’ alleged assailant, Paris Wilson, was booked on a misdemeanor assault charge and freed on $2,000 bail. Last Friday, Nettles’ death was officially ruled a murder. According to a spokesperson for the New York County District Attorney’s Office, Wilson has not yet been arraigned on any murder charges, telling TakePart that “charges will be updated pending further investigation.”

That investigation could go on for some time. Wilson’s next scheduled court date, isn’t until October 4.

The death of Nettles may strike some as a tragic, but otherwise freak incident for a progressive city like New York—one of the birthplaces of the modern LGBT-rights movement.

Statistics show, however, that isn’t the case. The world may be outraged over Russian anti-gay atrocities, but according to the NYPD, anti-LGBT “bias crimes” have nearly doubled since this time last year here in New York City, from 13 to 22 according to the NYPD’s most recent report on the issue.

“I don’t think people should be shocked [at the death of Nettles],” says Shelby Chestnut, codirector of community organizing and public advocacy for the New York Anti-Violence Project. “This happens more regularly than the media reports. We see this type of violence all the time.”

Back in May, Eugene Lovendusky, cofounder of the LGBT rights group Queer Rising, was assaulted by a 19-year-old man after being bombarded with anti-gay epithets. Lovendusky’s assault came amid a series of high-profile hate crimes against New York LGBT residents—most notably the May 17 murder of 32-year-old gay man Mark Carson, who was shot to death in the streets of New York after being called “faggot” and “queer” by his assailants.

Chestnut says her organization has seen a major uptick in anti-LGBT assaults this year. That said, the problem of anti-LBGT violence has always existed, she says. Reporting is improving, which could account for some of the increase.

Police mistrust, and a general lack of empathy, particularly towards the transgender and people of color, have hampered efforts to document anti-LGBT incidents of violence in the past.

“I don’t want to suggest [our stat] means more violence. These incidents may finally be reporting what has been happening in the streets for a long time.”

If nothing else, Chestnut hopes Nettles’ death will bring to light the tremendous violence faced by transgender women—particularly transgender women of color.

Seventy-two percent of anti-LGBT murders in America affected people of color and 53 percent of those were transgender women, Chestnut said.

The only way to end anti-LGBT violence is to keep talking about it and let the public know that incidents like the one that left Nettles dead are hardly uncommon, Chestnut said. Victims of hate violence also need to have the courage to come forward and tell their stories.

“Reporting violence helps end violence,” says Chestnut. “Unless we know where violence is occurring, we can’t do outreach in the area. We can’t reach out to the general public know that anti-LGBT violence shouldn’t be tolerated.”

Newtown shooter is described as isolated in youth

FILE - This undated identification file photo provided Wednesday, April 3, 2013 by Western Connecticut State University in Danbury, Conn., shows former student Adam Lanza, who authorities said opened fire inside the Sandy Hook Elementary School in Newtown, Conn., on Friday, Dec. 14, 2012, killing 26 students and educators. The state's Office of the Child Advocate is seeking the release of Lanza's school records. The office, which investigates all unexplained child deaths in the state, first subpoenaed the records in March, but Newtown school officials have not released the information. On Friday, Aug. 23, 2013, Attorney General George Jepsen asked a Superior Court judge to order the release of the documents. (AP Photo/Western Connecticut State University, File)

NEW HAVEN, Conn. (AP) — A portrait of a highly isolated young man with disruptions in his education is emerging as a state office investigating the Newtown shooter seeks the release of his school records.

Connecticut's child advocate office is seeking Adam Lanza's records as part of an investigation with its Child Fatality Review Panel into last year's massacre of 26 people at Sandy Hook Elementary School. Lanza, 20, killed his mother before the massacre and committed suicide afterward.

The panel reviews unexpected child fatalities. It has obtained some of Lanza's school and hospital records, but the state attorney general asked on the panel's behalf for the release of his educational records.

"I think from our perspective right now from what we've gathered, we're concerned about the level of isolation," said Faith Vos Winkel, assistant child advocate. "It's never one thing. I think a theme that is beginning to emerge for us — how it plays out, what it ultimately looks like, I'm not sure — is that this was a very isolated kid."

Teenagers and young adults typically are involved in sports, clubs, jobs, community activities and have friends, Vos Winkel said.

"I think at least from what we're gleaning at this point there was very little of that," Vos Winkel said.

Lanza attended a few middle schools, was home schooled and appears to have spent limited time in high school, she said. She compared the case to a 5,000-piece puzzle and said officials had only a limited number of pieces.

"Piecing this enormous complex puzzle together, we're beginning to see some education disruption certainly in middle school and, we believe, in high school," Vos Winkel said. "I think education disruption is a feature. Those will be some of the issues we're going to explore more fully."

Connecticut Attorney General George Jepsen wants a judge to order Newtown school officials to release Lanza's school records. The child advocate's office first sought Lanza's school records in March, but Newtown school officials have not released the information.

District officials did not immediately return a phone message left Monday.

Lanza killed his mother at their home, then killed 20 first-graders and six educators at Sandy Hook Elementary School before killing himself as police officers arrived.

The child advocate's office has subpoenaed many records, not just school documents, Vos Winkel said.

"I think we have an obligation to at least conduct a review to the extent that we can to collect information to say, what are the lessons potentially to be learned here?" Vos Winkel said. "We hope there is something to learn and we're going to look very hard to see what it is."

A prosecutor said this month that a report on the investigation into the shooting will not be available until the fall. Authorities have not disclosed a possible motive for the massacre, which sparked new legislation in Connecticut and beyond on issues including gun control and school safety.

Zimmerman lawyer to ask Florida to pay up to $300,000 in legal costs: report

(Reuters) - George Zimmerman, whose acquittal in the shooting death of unarmed teenager Trayvon Martin sparked protests across the United States, will ask Florida to pay up to $300,000 of his legal expenses, his attorney told the Orlando Sentinel on Monday.

Zimmerman will rely on state law that allows a defendant who has been found not guilty to be reimbursed for costs associated with a case, the paper reported.

Mark O'Mara, attorney for the 29-year-old Zimmerman, will soon prepare a motion seeking authorization of the payments and will submit that to the judge who presided over the case, the lawyer told the Orlando Sentinel on Monday evening.

O'Mara could not be reached for comment.

Zimmerman could not recoup attorney fees under the law, but he could seek costs related to the trial such as expenditures for expert witnesses and an animated video that defense attorneys showed jurors, the Orlando Sentinel reported. The costs could range between $200,000 and $300,000, the paper said.

Zimmerman, who is white and Hispanic, was found not guilty of murder and manslaughter on July 13 in Florida after a racially charged trial in the shooting of Martin, a 17-year-old African-American, in February 2012. Thousands of people demonstrated across the United States after the verdict.

Zimmerman was a volunteer neighborhood watchman in the central Florida town of Sanford, Florida, at the time of the shooting and said he acted in self-defense.
