MILWAUKEE (AP) — The trial for a Milwaukee man accused of gunning down his 13-year-old neighbor whom he suspected of stealing opened Tuesday with prosecutors promising to show jurors a video of the slaying.

The defendant's own security cameras captured the May 2012 shooting. Prosecutor Mark Williams said the footage provides "the best piece of evidence" to prove it was 76-year-old John Henry Spooner who killed Darius Simmons outside their homes.

"You're actually going to see the murder in this case," Williams told jurors during opening statements. "You're going see the terror in Darius' face. You're going to see how coldblooded and callous Mr. Spooner was."

The defense has conceded that Spooner fired the fatal bullet into Simmons' chest as they argued on the sidewalk. But defense attorney Franklyn Gimbel said the two issues at trial will be whether Spooner intended to kill the boy, and whether Spooner was suffering from mental illness that prevented him from knowing right from wrong at the time.

Spooner suspected his young neighbor had broken into his home and stolen guns, according to the criminal complaint. Spooner confronted the teen on the sidewalk two days after the burglary and demanded that he return them. When Simmons denied stealing anything, Spooner shot him once in the chest and fired a second shot as the wounded teen fled into the street, the complaint said.

Richard Martinez, one of the Milwaukee police officers who responded after the shooting, testified that Spooner offered an unsolicited confession upon his arrest. Martinez said he ordered Spooner at gunpoint to drop his weapon and Spooner bent down and laid his handgun on the ground.

Martinez testified that he was handcuffing Spooner when the man said, "Yeah, I shot him," referring to the teen.

Martinez said Spooner had another bullet in his pocket.

Martinez's partner, Michael Urbaniak, testified that he and Martinez placed Spooner in the back of a squad car while they investigated the scene. While being detained, Spooner commented that he had reached his breaking point and that his house had been broken into two days earlier, Urbaniak said.

The officer said Spooner claimed he knew the culprits were the kids who lived next door, and that they were part of a black family that recently moved next door and had caused nothing but trouble.

Officer Lori Borchert testified that she responded to the burglary report two days earlier. She said two windows on Spooner's home were broken and Spooner told her four shotguns were missing.

The day after the burglary, Spooner called Borchert and told her that his surveillance video captured images of the suspects. She said she viewed the video and that it showed two different black teenage males coming from the area of Simmons' home and moving toward Spooner's home.

She said she didn't arrest anyone because there wasn't enough probable cause. She said the faces on the video weren't clear, and the teens didn't appear to be holding any of the missing guns.

Gimbel, who limited his cross-examinations, told jurors during opening statements he intends to raise questions about whether Spooner, who's charged with first-degree intentional homicide, actually had the requisite intent to commit homicide.

"We will focus on what was Mr. Spooner's intent when he pointed the gun and pulled the trigger," Gimbel said.

Charles Ramsey says fame has ruined his life




The man credited with helping save three women from accused kidnapper Ariel Castro says the ensuing fame has ruined his life, even though he is set to earn $50,000 and has bought himself a BMW.

“I don’t have an address, I don’t live anywhere. I go from house to house, to friend to friend, to family member to family member,” Charles Ramsey said in an interview with the Daily Mail. “What I’ve been doing for the past four weeks is wearing out my welcome with everybody who knows me.”

Ramsey, 45, who worked as a dishwasher at the time the kidnapping story broke, says the real problem is that he can’t land a full-time job or housing because people are wary of the attention his presence would attract.

“Just give me a job,” he said.

Since the story broke in May, Ramsey said he’s used the money he has received to pay off debts and to buy a used BMW for $8,000. He’s received about$15,000 in speaking fees and several thousand dollars incorporate speaking engagement fees. He also launched a personal website, where he sells T-shirts bearing his image for $25, and digital downloads of the song “Dead Giveaway,” which uses clips from his 911 call and became a viral sensation.

'Charles has been absolutely marvelous to deal with,’ said speaking agent Bruce Merrin, who describes Ramsey as a “national hero” on his website.

And while he acknowledges buying the BMW, Ramsey says his new life is far from luxurious, pointing out that he is homeless and has spent several nights sleeping in the car.

“I got a car, most humans do,” he said.

Days after the story first broke, Ramsey says he moved out of his neighborhood and into a small hotel room outside Cleveland. Along the way, he claimed that no fewer than a dozen landlords have denied his rental applications because they fear unwanted attention from the man whose YouTube video has racked up more than 16,000,000 views.

Ramsey also tells the Daily Mail that fame has brought him other unwanted headaches as well. For example, he’s allegedly tried to shut down a counterfeit Facebook page and has unsuccessfully tried to stop a Chinese company from selling a video game that uses his image as a character.

“I’m borrowing money from my relatives. I don’t even answer my phone anymore because [my creditor] keeps calling,” Ramsey said.

Nonetheless, Ramsey tells the paper he wouldn’t trade in his notoriety, despite all of the problems it has caused for him.

“Would you go back to not being famous? Yes or no? Of course not, no you wouldn’t, so going back as far as me being famous, of course I’m not gonna give that up.”

The last few stories were quite interesting. I remember a time when, if a minor committed murder they could not be tried for murder because they were too young to know what they were doing. Now, because a man is in his seventies, he is considered insane. I was completely shocked when I learned the results of the Zimmerman Trial. Even though, over the past few months, Zimmerman changed his story at least three times. In a way, I am sometimes a little afraid of living in Indianapolis. This years murder rate is already higher then last year and the year is only half over. People are jailed for violent crimes and released in short amounts of time, until they finally kill someone. I'm not sure if there is any answer to this problem because even when they do stand trial, the jurist aquits them of any wrong doing. I know that prisons are running out of room, but that should be no reason to allow potentially dangerous people back into society. Instead of double bunks, install triple bunks. Turn the Recreation hall into more sleeping quarters. In reality, there should not be a three strike system. One strike and you are out. Honest, law abiding citizens should not have to live in fear.

Yes Mike, the world is all around becoming a place increasingly dangerous to live in and it is the lawmakers that are to blame for it, not the people in general (o
r are they? After all, it is they that elect the lawmakers). The case of Trayvon Martin, with its terribly unjust verdict, exemplifies this. If you abide by the rules, call it "Stand your Ground" or whatever, and you are not black or poor, that is, or too attractive a your girl, there is nothing you can do about it except try to do the least noise about anything, keep the lowest possible profile in all your activities outdoors, avoid people and places that are not totally congenial with you or your appearance, et cetera. I reaffirm in my belief that we have reached a point where we are badly in need help from above... or else.

This image of Martin Luther King Jr. wearing a hoodie, which appears to be created by artist Nikkolas Smith, has gone viral.

The niece of Dr. Martin Luther King Jr. says she is not a fan of the viral image of her uncle wearing a hoodie in support of Trayvon Martin. The image, created by artist Nikkolas Smithand spread widely by activist Van Jones on Twitter, shows a contemplative King wearing the garment, which has become a symbol of support for the slain 17-year-old.

“I can almost promise you Dr. Martin Luther King Jr. would not wear a hoodie,” said Alveda King on the Andrea Tantaros radio show Tuesday when asked about the image. Alveda King is a former state representative in Georgia and a right-wing anti-abortion activist and minister.

King said she and two of her cousins are calling on Americans not to “fight or debate” about the case, which she thinks did not raise any significant racial issues. The 29-year-old neighborhood watchman who shot the unarmed Martin, George Zimmerman, was acquitted of all charges against him on Saturday. Zimmerman is half Hispanic, Martin was black. “You've got two grieving and hurting families,” King said, before quoting her uncle. “We all need to live together as brothers.”

Tantaros asked King if she had seen the hoodie photo. “What do you think of this image? And what would your uncle think?” she asked.

“Dr. Martin Luther King Jr. would very likely not wear a hoodie,” she said. “I can assure you he would not wear sagging pants. I don't even think I’ve ever even seen his sons with sagging pants.” King then said the verdict had been reached and that Americans must accept it, before adding again, seemingly agitated, “I can almost promise you Dr. Martin Luther King Jr. would not wear a hoodie.“
