My son was involved in a vehicle accident

I just wanted to discuss what has happened
and
also having a little rant about the injustices that
has occurred.



This photo is my son Daryl who is 23 years old. He
was involved in an accident about a month ago when
a van hit him on his motor cycle at a round-about.
Daryl had right-of-way.  Daryl sustained a lot of severe damage to his leg, and foot and also his hand. His
hand has yet to have something done to it in the way
of therapy.


His totaled bike. Only a few months old.


His leg before surgery - He had already had surgery
done on this knee from a previous injury. This latest
injury will leave him with limited mobility for life.


After surgery, the swelling was so great the surgeons
could not close up the bottom part of the incision.

He is unable to work and is just starting treatment
with the physio-therapist. Until he can weight bare
he is limited to any other treatment.

I received an email from him saying that the man
whom hit him went to court and he has been fined
NZ$1,000 to Daryl, I do not know what or how
$1,000 is suppose to support Daryl.  He has had
to give up his apprenticeship (last year) in
engineering his apartment (luckily he was renting
with others so has not broken any contracts) and
live back with his father, in the small town he
wanted to leave as there is nothing for him to do
there. 

He is suppose  to draw ACC (accident compensation claim) that tax payers pay into for people who have accidents, that no-one is at fault for.

My problem with this is; Tax payers should not be paying for this accident that this driver did not stop
at the intersection that he was required by Law to
obey.
Daryl having to draw on this benefit in my
opinion, drains funds that has been collected for
people that have the accidents that these funds are designed for.


This driver that hit him should be paying more than $1,000 towards Daryl's expenses as his vehicle insurance should be covering what ACC is going to
have to pick up the bill for.

I am so far away from him right now and I know even
if I was there in person there is nothing else I can do,
to help the situation as it lays.  I am frustrated and
annoyed.

The laws in 'so called civilized countries' seems so
lax and inconsistent, especially for many law breakers
that should be punished severely and are not - yet
other people that happen to be 'in the wrong place at
the wrong time'  these inconsistent laws can hit
innocent people severely.

Hi Amanda if i can say a few words, first i know what feels like to have a motorcycle accedent , not a very good feeling to say the least, i will pray for your son as i have before wheni heard of this. Now it sounds to me that the person who is sending you this 1000 NZ money is just buying you off, if it happened here in America it would be wrong and we would take him to court. 1000 dollars is chump change when it comes to any accedent around here. That isnt enough to cover a weeks worth of anything here at any hospital in america. Im praying for you and the shaver family Amanda. You see what you can do. You have my number anyway. Hi Tom,

Thanks for coming in, and placing Daryl in your
prayers.

I just want to clear up where there seems to be
a little misunderstanding..

The driver who hit Daryl in New Zealand was
sentenced in his court hearing, and the fine the judge gave this driver was NZ$1,000.00 to be paid to Daryl.

I reckon the lawyer that respresented this driver
and the court costs would amount to approx
$1,000.00! so to me it is an insult to Fine this
pultry amount to Daryl.

Like you have said, this is 'chump change' and insult
ontop of injury to a young man that still has his
whole life before him to fulfill his dreams.

Dear Amanda,

Im so sorry for what happened to your son, will pray for his fast recovery.

Pray also he is able to get what is due to him..the driver who didn't respect the laws of driving should be punished and fined heavily too as you so rightly point out.

Hi Amanda i will say a few words, first i its so sad your son is going through that my mother last year went through the same and nearly lost her leg i know what feels like to have a motorcycle accedent , not a very good feeling to say the least, i will pray for your son quick  recovery.You are even luck your are getting the 1000 here in uganda you dont get anything at all ,and that is it,so its really very unfair how things work,somebody will hurt u even if u a in the right of way and will just drive off,if there is away you can get more than that push for it.
